Applicant Privacy Notice

InterDigital, Inc., its subsidiaries and affiliates (collectively referred to herein as “InterDigital”), respects your privacy and will treat your personal information as confidential. InterDigital will use or share personal information to InterDigital as described in this Applicant Privacy Notice (or “Notice”). 

By using this site, or submitting this information, you expressly consent to the terms of this Notice, and to the collection, storage, use, transfer, and disclosure of your personal information, including any sensitive information that you elect to submit under the terms and conditions provided in this Notice. 

Personal Information We Collect About You 

When you apply for employment or engagement with InterDigital, we may ask you to provide certain personal information about yourself in order to evaluate your application. You may also voluntarily provide information which is not requested by InterDigital, but which you believe may assist us in evaluating your application. This information may include one or more of the following: 

  • Name, identify, and personal and/or business contact information; 
  • Employment details including past and present employment history; 
  • Background information regarding educational degree(s), professional training, financial and/or credit history, and other similar information; 
  • Resume or CV, cover letter, transcripts or certifications; 
  • Desired salary, relevant work experience, type of employment sought, date of availability, employee referral contact information; 
  • IT information provided through your online interaction with any InterDigital websites or online media which may be sent to us by your computer, mobile phone, or other access device (e.g., data about the web pages you access, your computer IP address, device identifiers, the type of operating system you are using, your location, mobile network information, standard web log data such as browser type, or other information); 
  • Any other information in your application which you choose to share with us such as personal preferences, certifications, hobbies, and the like; or, 
  • Information from the InterDigital site or other third party online sources, to the extent permissible by law. 

If you accept employment with InterDigital, the information collected will become part of your permanent employment record and will be used for employment purposes. 

Sensitive Personal Information 

InterDigital does not require that you submit sensitive personal information regarding religion, health, sexual orientation or political affiliation in connection with your application. If you have a disability and would like for us to consider an accommodation, you may provide that information during the recruitment process. 

For some countries, InterDigital may ask for information such as race, ethnicity or gender for the purposes of monitoring equal opportunity and export control compliance; however, for the purposes of your application we do not require applicants to provide this information. If you provide this information it will not be considered in the hiring or selection process. To the extent that you provide us with sensitive personal information (race, ethnicity, political opinions or beliefs, membership of a trade union or political party, physical or mental health information, sexual orientation or information related to criminal convictions or offences), you expressly authorize InterDigital to handle such information in accordance with this Notice. 

Information from Third Parties 

InterDigital may obtain information about you from public sources or third parties. For example, we may conduct background screenings through a third-party service provider and verify information in your application that relates to past education, employment, credit and/or criminal history, as allowed by applicable law. You may also choose to provide us with access to certain personal information stored by third parties such as job-related social media sites. By authorizing InterDigital to have access to this information, you agree that InterDigital may collect, store and use this information in accordance with this Notice. 

How Your Personal Information Is Used 

InterDigital will use your personal information for the following purposes: 

  • Evaluation of your candidacy for employment or engagement with the company; 
  • Administration and management of your application such as analysis of your application; 
  • Compliance with federal, national, state, and local laws and regulation for recruiting and employment; and, 
  • Communication with you regarding the status of your application or future opportunities. 

Profiling and Automated Decision Making 

InterDigital does not make any automated decisions (in other words, without human involvement) in relation to the evaluation of your candidacy for employment or engagement with the company. InterDigital may process some or a part of your personal data for data and statistical analysis relating to your employment or engagement (such as global recruiting analysis and diversity monitoring) where permissible, applicable, or required by law, regulation, or InterDigital’s legitimate interests. 

Sharing of Personal Information 

InterDigital may disclose your personal information with the following types of third parties: 

  • InterDigital subsidiaries or affiliates related to the InterDigital entity to which you applied; 
  • Third party service providers to InterDigital such as recruitment agencies, consultants, background services and professionals; 
  • Other third parties as needed to comply with our legal obligations (including a court order or government request); 
  • As necessary to establish, exercise, or defend our legal rights; 
  • As necessary to protect your vital interests; 
  • Where we have otherwise obtained your consent. 

Legal Basis for Collecting and Processing Your Personal Information 

If you are a natural person located in the European Economic Area and Switzerland (“EEA”), the legal basis for our collecting and processing of your personal information is as follows: 

  • InterDigital’s legitimate interests, namely the recruitment, selection, evaluation and appointment of new employees or consultants, as well as the management and administration of the recruitment and human resources process of InterDigital’s business operations, to the extent these activities do not prejudice or harm your rights and freedoms; 
  • Compliance with InterDigital’s legal obligations where employment law or other laws require the processing of your personal information; or, 
  • Other legal grounds where applicable or required such as in your vital interests (for example, health and safety reasons if you attend an interview at our site) or in regard to employee representations.

Retention of Personal Information 

InterDigital will retain your personal information for as long as necessary in connection with the purposes described in this Notice and in accordance with InterDigital’s Records Retention Policy and any applicable law or regulation. International Transfers 

InterDigital will be responsible for the secure access of your personal information. InterDigital may process your personal information in the local country where you submitted your application, at its headquarters in the United States, or through our global recruitment platform. This may involve transferring your personal information, including personal information collected in the EEA and Switzerland, to the US and other countries. 

Security and Confidentiality 

InterDigital maintains appropriate organizational and technical measures designed to protect the security and confidentiality of any personal information it processes. Your Responsibilities 

You are responsible for the information that you provide to InterDigital. It must be honest, accurate and not misleading in any way. If you provide information concerning any other person, such as individuals you provide as references, you are solely responsible for providing any notices to, and confirming that, your reference consents to the collecting and processing of that information as described in this Notice. 

Your Rights (for EU Data Subjects or Natural Persons in Certain Other Jurisdictions): 

If you are a data subject of the European Economic Area and some other countries or certain other jurisdictions, you may have certain rights available to you under applicable data protection laws which may include one or more of the following: 

  1. Access: You may have the right to request information about how we process your personal data and obtain a copy of that personal data; 
  2. Rectification: You may have the right to request the rectification of inaccurate personal information about you and for any incomplete personal information about you to be completed; 
  3. Objection: You may have the right to object to the processing of your personal information which is based on our legitimate interests (as described above); 
  4. Erasure: You may have the right to request the erasure of your personal information; 
  5. Automated decision-making: You may have the right not to have a decision made about you that is based solely on automated processing, including profiling, if that decision produces legal effects about you or significantly affects you; 
  6. Restriction: You may have the right to ask us to restrict our processing of your personal information, so that we no longer process that information until the restriction is lifted; or, 
  7. Portability: You may have the right to receive your personal information, which you have provided to us, in a structured, commonly used and machine-readable format and to have that information transmitted to another controller in certain circumstances. 

Amendment and Updates 

InterDigital may amend this Notice at any time by posting a revised version on our site. The revised version will be effective as of the “Effective Date” provided thereupon.
